Kampala City businessman Alhajji Mutaasa Kafeero has petitioned the Commercial Division of the High Court to compel car dealer Seguya Yassah Matovu to refund a balance of 300 million Shillings for selling him an old model Range Rover contrary to their agreement.

According to court documents, Mutaasa Kafeero signed an agreement with Matovu to purchase a 2023 Grey Range Rover Vogue, a seven-seater, for 900 million shillings. However, Matovu delivered a 2022 model lacking the specific features Kafeero had requested.

Mutaasa Kafeero alleges that Matovu claims the remaining 300 million shillings is a non-refundable deposit. Kafeero seeks a court ruling on whether the 2022 Range Rover, registration number UBQ 436E, supplied by Matovu matches the description in their sales agreement, and if he is entitled to a refund of 300 million shillings under the terms of the agreement.

Kafeero argues that, based on legal advice from Muwema and Company Advocates, this is a straightforward case requiring only the interpretation of the sales agreement in relation to the vehicle supplied, without the need for additional evidence.

Following the filing of the case, the Commercial Division High Court Registrar has summoned Seguya Yassah Matovu to appear in court next month if he wishes to present his side.

“You are hereby required, if you desire to be heard upon determination of the said questions, to appear personally or by an advocate before the High Court on July 10, 2024, at 2:00 PM, when this court will proceed to make such orders, whether by declaration or otherwise, as the court may think just and expedient,” reads the summons.
