A Ugandan woman based in the United States has spent months looking for her husband so she can get a divorce.
For months, Maritaniya Malinda has spent money on newspaper adverts looking for the whereabouts of Emmanuel Nsenga. The petitioner claims that although she wants a divorce, she is unable to locate the respondent.
“The petitioner is requesting a divorce because of the need for divorce,” reads one of the notices in the newspaper.
Malinda is a resident of 176 Blake St., Lewiston, ME 04240.
Her estranged husband lives in Uganda.
What happens
Legal brains say that if you want a divorce but cannot locate your spouse, you can apply to the court for substituted service or dispensation of service. This allows you to proceed with the divorce even without directly serving your spouse. However, they add that “you’ll need to demonstrate to the court that you’ve made reasonable attempts to find your spouse.”
