A senior lecturer’s bid for more than Shs 300 million in compensation after his dismissal from Cavendish University Uganda has been dismissed by court, which found that his termination was substantively and procedurally fair.
The case, heard before Hon. Justice Anthony Wabwire Musana with panellists Hon. Can Amos Lapenga, Hon. Emmanuel Bigirimana and Hon. Dr. Oling Dawn Kerjew, centred on Dr. Fredrick Kiwuuwa Lugya’s claim that his dismissal over alleged dual full-time employment was wrongful, unjustified and unlawful.
Court heard that Dr. Lugya, who joined Cavendish as a Senior Lecturer on a two-year fixed-term contract in November 2016, was also a full-time employee of Makerere University Kampala, contrary to Clause 12 of his contract.
After a disciplinary hearing on November 3, 2017, he was summarily dismissed.
The court held that, “while the issue was framed as a question of termination, based on the facts, evidence, and Counsel’s approach, it is clear that the reason for the Claimant’s dismissal was misconduct,” and further ruled, “accordingly, it is our judgment that the Claimant’s dismissal was substantively fair.” It added: “The Claimant has not established any wrongs in these proceedings.
Consequently, no remedies or damages are awardable, and the claim is dismissed in its entirety with each party bearing its own costs,” court ruled on July 23rd.
